Filing for Social Security Disability

Social Security benefits are important sources of income for many people in Western Kentucky.  As an attorney handling Social Security claims, I’ve been able to work with the various programs to ensure my clients have filed for the proper types of available programs. This article will provide information if you’re going to file for Social Security benefits. What is Supplemental Security Insurance (SSI)? One of the programs available is Supplemental security income or SSI.  This is typically designed for people who are disabled but have limited or no employment history …

Complex Trucking Collision Cases

There’s nothing simple about a trucking collision.  A wreck involving a tractor trailer is one of the most complex legal cases an attorney can handle.  The injuries are typically severe, and unfortunately may involve a traffic fatality.  The various experts involved, including accident reconstructionist, life-care planners and physicians will provide various reports and opinions.  There are multiple insurance companies involved – usually all trying to convince the judge, jury and even the victim that it was the driver of the car’s negligence which caused the accident. Now, from a legal …

School Bus Safety

While we are still in the middle of the summer heat, summer break is almost over for our kids.  In a couple of weeks, school buses will be on the road and kids will be on the sides of our streets.  According to the Kentucky Department of Education, 385,000 kids are transported to and from school every school day in Kentucky on nearly 10,000 school buses.  That’s a lot of kids and a lot of buses. Let’s discuss school bus safety. We have been traveling to a from work for …

Client Testimonial – Construction Accident

One of my clients was a Western Kentucky construction carpenter who suffered a back injury and required multiple surgeries, including a lumbar fusion. I’m proud to have earned the comments he shares in this brief video.

Liability for a Secondary Crash in Kentucky

As a personal injury attorney in western Kentucky, I’ve handled hundreds of automobile accident cases.  The media tends to focus on wrecks, especially when they involve a tractor trailer accident.  It’s often related to driver error by the trucker who’s rushing to meet a delivery deadline, driving aggressively or who experiences a mechanical failure of some kind.  However, there’s another risk to drivers. Once an automobile collision occurs, the other drivers have to react quickly to sudden stops and evasive lane changes.  If those actions result in another collision, who …

Kentucky Loss of Limb Injury

As a personal injury attorney, I’ve seen examples of many types of car wreck injuries.  We commonly think of broken bones, neck or back injuries.  Some of these are reduced as more people remember to use their seat belts.  However, this safety measure doesn’t prevent a loss of limb injury. In an automobile accident, the forces exerted on the human body are extremely violent.  If the collision results in a rollover, hands and arms can be severely damaged if they are extended outside of the car and get trapped between …

Intersection Wreck Involving 3 Cars

Intersections are among the most dangerous areas of the road.  If you think about it, you probably travel through hundreds of them each week.  A recent western Kentucky newspaper reported an intersection wreck involving 3 cars. In this collision, the first car was struck by the second car and they collided with a third car, which was sitting at the intersection.  Even if you’re not in one of the cars involved in the primary collision, this example proves how other vehicles can also be at risk. Common Causes for Collisions …

Distracted Driving in Western Kentucky

Earlier this summer, KFVS12 reported on a Livingston County fatal collision involving a car and a tractor trailer.  It appears the driver of the car didn’t realize that traffic had slowed ahead of her.  She apparently tried to switch lanes but was forced to return to her lane.  She collided with a tractor trailer after losing control of her car.  It may have been a case of distracted driving. Unfortunately, we see all too many wrecks on I-24.  Between construction zones, access ramps, tractor trailer traffic and inattentive drivers, it …

Be Safe This Halloween

Autumn is upon us.  Here in our beautiful part of the state, it means Friday night football, MSU Racer football and some great times with family and friends.  October 31st is a fun evening that kids and parents look forward to each year. The Roberts Law Office wants to remind all of us to be safe this Halloween. Many communities have moved up the time for trick or treating from the time when I was a child.  This enables younger children to make the rounds before the sun goes down.  …

Can Passengers Sue the Driver?

Last week, a teenager was driving when the car ran into the median.  It subsequently flipped onto its side.  The driver was accompanied by two passengers.  There are no further reports about injuries.  So, what happens if you’re a in a one car accident in a car driven by someone else?  Can passengers sue the driver? As with any car wreck, if you are hurt in an accident, seek immediate medical attention.  The reason for doing this, even if you think it will be fine, is to document any injuries.  …
